Going back to the tax issue, this is what someone emailed me out of the blue yesterday: (I had posted on the matty forum asking why I was charged tax.)

So who else has been charged tax? I know NJ and MA are the two state thus far. I work for a Senator here in NJ, so I have a call out to my liaison at Treasury as to why I am being charged tax as we haven't heard anything about this. I'll keep everyone posted.

Sounds like some of you guys don't understand how sales tax works.

Digital River (and Mattel for that matter) are required to collect sales tax in ALL states in which they have a physical business presence. It does not matter if you purchased online or not, nor where the item shipped from.

For example Minnesota is charged sales tax because Digital River has offices (their headquarters) in Minnesota. Therefore, even if you are ordering the item from Digital River in California, and they ship the item from California.. MN sales tax still needs to be collected. It probably extends further into Digital River subsidiaries as well. If those subsidiaries are located in your state, boom sales tax. Its not inconstancy. Its law.

I understand sales tax, my main question is why all of a sudden are they collecting it when they haven't collected it before. Not to mention there hasn't been any legislation regarding it.

They have always collected it from me.

Digital River and Mattel are big companies that are always expanding, and always buying up smaller companies. I'm sure if they just started collecting for your state, they recently aquired a new business.

he means the NECA Gozer figure, NECA had the Ghostbusters license for a short time, they produced excellent versions of Slimer, Gozer, and 2 (slightly different) Terror Dogs and a big Stay Puft... I would love to hear the story from the horses mouth as to why they didnt make the actual Ghostbusters themselves and why they dropped the license before it could happen, though Im sure it has quite a bit to do with actor likenesses.

I just got off the phone, I went from Treasury to Taxation to Regulatory Services to a Sales Tax Specialist. I was informed that:

Unless Mattel agreed to voluntary collect sales tax, they are not required to collect sales tax unless they have a physical location in the state. It's a privacy issue as to if they are registered here in New Jersey or not.

It was also suggested that Mattel may have entered into a Streamlined Sales Tax agreement. This seams to make sense as everyone who has posted thus far that has not been charged tax, resides in states that are not apart of this agreement.
